The subject of this agreement is to set out the rights and obligations of the parties, in accordance with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the products described below with their characteristics and sale price, which the Buyer has ordered electronically from the Seller's website bytooche.com.

The name, colour, quantity, unit and total price including taxes, and the shipping fee of the products subject to this agreement are those shown in the payment step when the order is placed and included in the order confirmation.
Prices include VAT. Payment is taken in full by credit or debit card through the infrastructure of a licensed payment institution. For orders below ₺1,250.00 after any coupon discount, a shipping fee of ₺125.00 is paid by the Buyer; shipping is free for orders of this amount or more.
Article 4 – General provisions
4.1. The Buyer confirms having read the Pre-Contractual Information Form on the main characteristics of the products, the sale price, the payment method, delivery and the right of withdrawal, and having given the necessary approval electronically.
4.2. The products are handed over to the courier within 2 business days at the latest after the payment is confirmed (plus 1 business day for personalised products) and in any case delivered to the address provided by the Buyer within the legal limit of 30 days from the date of the order. The courier company and tracking number are sent to the Buyer by email.
4.3. The product is delivered to the Buyer or to a person at the address provided by the Buyer. If the package is damaged, it is recommended to have the courier draw up a report; this recommendation does not limit the Buyer's legal rights.
4.4. If supplying the ordered product becomes impossible, the Seller informs the Buyer within 3 days of learning this and refunds all payments collected within 14 days of the notification at the latest.
4.5. The invoice for the order is sent to the Buyer with the product or electronically.
Article 5 – Right of withdrawal
5.1. The Buyer may withdraw from the agreement within 14 days of receiving the product without giving any reason and without paying any penalty. For orders where several products are delivered separately, the period starts on the day the last product is received. The Buyer may also exercise the right of withdrawal before the product is delivered.
5.2. The withdrawal notice is given within this period by email to info@bytooche.com, through the contact form on the website, or in writing to the Seller's address.
5.3. The Buyer sends the product back to the Seller within 10 days of the withdrawal notice. For shipments made with the return code provided by the Seller via DHL eCommerce, the return shipping cost is borne by the Seller; if the Buyer uses a different courier company, the shipping cost is borne by the Buyer.
5.4. Within 14 days of receiving the withdrawal notice, the Seller refunds all payments collected, including the delivery fee, using the payment method the Buyer used and without charging the Buyer anything.
5.5. The Buyer is not responsible for changes or deterioration as long as the product is used in accordance with its function, technical specifications and instructions for use.
Article 6 – Cases where the right of withdrawal does not apply
The right of withdrawal does not apply to personalised products prepared according to the Buyer's requests or personal needs (products with a name, letters or a special finish, etc.) (Distance Contracts Regulation Art. 15/1-ç). Legal rights regarding defects remain reserved for these products.
Article 7 – Defective products
If the product is defective, the Buyer may exercise one of the rights listed in Article 11 of Law No. 6502: withdrawal from the agreement, price reduction, free repair, or replacement with a non-defective equivalent. Shipping and return costs of defective products are borne by the Seller.
Article 8 – Dispute resolution
For disputes arising from this agreement, the consumer arbitration committees where the Buyer lives or where the transaction took place are competent within the monetary limits announced each year by the Ministry of Trade, and the consumer courts are competent for disputes above these limits. In the cases set out in the law, applying to a mediator before filing a lawsuit is mandatory.
Article 9 – Entry into force
The Buyer has read and electronically approved this agreement and the Pre-Contractual Information Form before the payment step. The agreement is concluded when the payment is confirmed. The Seller keeps the agreement and the approval record with the order; the agreement is sent to the Buyer with the order confirmation email. Text version: 1.1.
